PLEASE READ THESE TERMS CAREFULLY

These Terms contain a binding individual-arbitration agreement and class-action waiver. Unless you timely opt out, most disputes must be resolved through individual arbitration rather than in court. See Section 22.

These Terms of Service (the “Terms”) govern your access to and use of guesthub.us and any related websites, portals, forms, communications, and guest-management services made available under the Guest Hub brand (collectively, the “Service”). Guest Hub (“Guest Hub,” “we,” “us,” or “our”) is operated as a sole proprietorship under the trade name Guest Hub. References to Guest Hub, “we,” “us,” or “our” refer to the sole proprietor operating the Guest Hub platform and services.

By accessing or using the Service, submitting guest information, consenting to electronic communications, or clicking an acceptance control, you agree to these Terms. If you do not agree, do not use the Service. A participating rental owner, operator, manager, or other accommodation provider is referred to as a “Host.”

1. Eligibility and authority

You must be at least 18 years old and legally capable of entering a binding contract. If you use the Service for another guest, a business, or an organization, you represent that you have authority to provide the information and bind that person or entity where legally permitted. You may not submit another person’s sensitive information without authorization.

2. Guest Hub’s role and relationship with Hosts

Guest Hub provides technology and administrative tools used by Hosts to collect guest details, coordinate stays, verify identity, communicate, manage access, request or administer authorized payments or deposit holds, and support related operations. A Host may be an independent business and is responsible for the rental property, the accuracy of its listing, habitability, onsite conditions, refunds, taxes, house rules, accessibility, and performance of the lodging agreement.

Unless Guest Hub expressly identifies itself as the accommodation provider for a particular reservation, Guest Hub is not the landlord, hotel, travel agent, insurer, or contracting Host. These Terms supplement, and do not replace, the Host’s rental agreement, house rules, cancellation policy, or the terms of Airbnb or another booking platform. If terms conflict, the term governing the specific transaction controls to the extent allowed by law; these Terms continue to govern use of Guest Hub’s Service.

3. Accounts, session recognition, and guest profiles

The Service may create a guest profile or recognize your browser or device using cookies, tokens, links, telephone numbers, or similar technology. You are responsible for maintaining control of your device, links, access codes, and session. Notify us promptly if you suspect unauthorized use. We may require re-verification, invalidate a session, or restrict access to protect you, a Host, a property, or the Service.

4. Accurate information and cooperation

You agree to provide current, accurate, and complete information and to update it when necessary. This may include your name, contact details, address, reservation information, identity documentation, payment or deposit information, vehicle or arrival information, and names of authorized occupants. You may not impersonate another person, use fraudulent documents, conceal unauthorized occupants, or circumvent verification or property-access controls.

5. Identity, fraud, and eligibility verification

A Host or Guest Hub may require identity, age, booking, payment, fraud-risk, or eligibility verification. Verification may involve a government-issued identification document, a photograph or selfie, document-authenticity checks, database or booking-platform comparisons, and review by specialized service providers. Where required by law, additional notice or consent will be provided before processing biometric identifiers or similar regulated data.

Passing a verification does not guarantee identity, character, safety, creditworthiness, or compliance. We may decline, pause, or refer a verification to the Host or booking platform. A Host’s decision remains subject to applicable law and its contractual obligations.

6. Reservations and third-party booking platforms

Reservations may originate through Airbnb or another booking platform. Guest Hub may receive reservation details from you, a Host, or that platform. Guest Hub does not control third-party availability, listings, payment rules, cancellations, reviews, or outages. Your dealings with a booking platform remain governed by that platform’s terms and privacy practices.

7. Payments, card authorizations, and security-deposit holds

The Service may allow a Host or its payment processor to collect charges, verify a payment method, or place an authorization hold for incidentals, damages, rule violations, unpaid amounts, or other disclosed purposes. The amount, duration, release, and circumstances for capture should be disclosed by the Host or booking flow. You authorize the relevant payment processor, Guest Hub acting for the Host, and the Host to initiate the disclosed authorization or charge, subject to applicable law, card-network rules, and the governing rental terms.

Guest Hub may receive transaction status, tokenized account information, card brand, expiration information, billing address, or limited card digits, but payment providers may collect and store full payment credentials directly. Bank processing times can delay the release of a hold after release is initiated. Dispute an unauthorized or incorrect charge promptly through the support method shown for your reservation and, when appropriate, your card issuer or booking platform.

8. Property access, smart locks, and security

The Service may generate, transmit, display, or revoke door codes, lock credentials, Wi-Fi details, parking instructions, or other property-access information. Access credentials are personal to the authorized guest and reservation. Do not publish, sell, forward, or share them with unauthorized persons. Access may be time-limited and may depend on third-party hardware, connectivity, batteries, power, or vendor systems.

You must follow the Host’s occupancy limits, safety instructions, house rules, and checkout procedures. Guest Hub does not guarantee uninterrupted access. If access fails, use the reservation’s support channel. For a fire, medical emergency, crime in progress, gas leak, or other emergency, contact 911 or the appropriate local emergency service; do not rely on Guest Hub text alerts or support.

9. Location and device permissions

With device or browser permission, the Service may use location signals to auto-populate a city, support fraud prevention, verify a relevant workflow, or tailor property information. Approximate location may also be inferred from an IP address. You may deny or revoke precise-location permission through device settings, although a feature may then require manual entry or may not function as intended.

10. Communications and electronic records

You consent to receive legally required notices and service communications electronically, including through the Service, email, or text when you separately opt in to text messages. You may retain copies by printing or saving them. You are responsible for keeping contact information current. If applicable law requires a non-electronic method, contact needhelp@guesthub.us.

11. Guest Hub Guest Alerts — SMS Terms

Program name and description. “Guest Hub Guest Alerts” is a recurring, non-marketing messaging program providing reservation confirmations, identity-verification codes, check-in and access instructions, stay-related and safety alerts, guest-support replies, checkout reminders, and post-stay review or feedback requests concerning a guest’s reservation. Guest Hub does not use this program for discounts, advertising, or future-stay promotions. Any future marketing program would require a separate, optional express consent.

Consent. You receive Guest Hub Guest Alerts only after providing consent through an SMS-specific opt-in method. SMS consent is voluntary, is not a condition of booking, purchasing, or using unrelated services, and is separate from acceptance of these Terms. The checkbox must be unchecked by default. Consent applies only to the identified program and sender and is not transferable to unrelated businesses. You may be asked to confirm your opt-in.

Frequency and charges. Message frequency varies based on the reservation and guest activity, but will not exceed 20 messages per month. Message and data rates may apply. Your wireless carrier’s terms govern charges.

Opt out. Reply STOP to any Guest Hub message to cancel. You may also use any other opt-out keyword supported in the message. After opting out, you may receive one final confirmation. No further program messages will be sent unless you separately opt in again. Opting out of SMS does not cancel a reservation and does not prevent non-SMS communications that are legally permitted or necessary to administer a transaction through another channel.

Help. Reply HELP for help, visit https://guesthub.us, or email needhelp@guesthub.us. If you opt out, obtain time-sensitive check-in or stay information through the Guest Hub portal, email, booking platform, or the Host’s available support channel.

Delivery. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to carrier availability, filtering, device status, network conditions, and correct contact information. Guest Hub does not guarantee delivery or timing.

Telephone-number changes. If you stop using or transfer a mobile number, you must update your Guest Hub information or opt out before relinquishing it. You represent that you are the subscriber or customary user authorized to consent for the number provided.

Privacy. Mobile information is handled as described in the Guest Hub Privacy Policy at https://guesthub.us/privacy-policy. SMS opt-in data and consent are not sold or shared with third parties or affiliates for their marketing or promotional purposes.

12. Prohibited conduct

You may not:

·        use the Service unlawfully, deceptively, fraudulently, or to harm another person, property, or system;

·        probe, scan, disrupt, overload, scrape, reverse engineer, bypass access controls, introduce malicious code, or interfere with the Service;

·        use automated means to access the Service except through an authorized interface;

·        upload content that is unlawful, infringing, threatening, defamatory, sexually exploitative, or invasive of privacy;

·        misuse identity documents, payment credentials, access codes, communications, or another guest’s information;

·        remove proprietary notices, impersonate Guest Hub or a Host, or falsely imply endorsement; or

·        use the Service to send unsolicited messages or violate telecommunications, privacy, consumer-protection, lodging, or safety laws.

13. Guest content and feedback

You retain ownership of information, messages, files, images, and other material you submit (“Guest Content”). You grant Guest Hub and the applicable Host a nonexclusive, worldwide, royalty-free license to host, copy, transmit, display, process, and use Guest Content only as reasonably necessary to provide, secure, improve, document, and enforce the Service and the reservation, comply with law, and resolve disputes. You represent that you have the necessary rights to submit it.

If you voluntarily provide product feedback or suggestions, Guest Hub may use them without restriction or compensation, provided it does not publicly identify you in violation of the Privacy Policy.

14. Intellectual property

The Service, including its software, design, text, graphics, trademarks, workflows, and non-guest content, is owned by Guest Hub or its licensors and protected by law. Subject to these Terms, Guest Hub grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for legitimate guest and reservation purposes. No other rights are granted.

15. Third-party services and links

The Service may rely on or link to booking platforms, payment processors, identity-verification vendors, mapping or location providers, telecommunications carriers, messaging providers, analytics services, hosting and security vendors, smart-lock systems, and Host websites. Their services and privacy practices are governed by their own terms. Guest Hub is not responsible for a third party’s independent acts, content, availability, or security, except to the extent liability cannot legally be excluded.

16. Service availability, changes, and suspension

We may update, restrict, suspend, or discontinue features; perform maintenance; correct errors; or block activity that presents security, fraud, legal, operational, or safety risk. We will use reasonable efforts to avoid unnecessary disruption but do not promise uninterrupted or error-free operation. We may preserve information as reasonably necessary for security, legal compliance, disputes, or enforcement.

17. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” GUEST HUB DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT. GUEST HUB DOES NOT WARRANT THAT VERIFICATION WILL IDENTIFY EVERY RISK; THAT A HOST, GUEST, PROPERTY, LOCK, PAYMENT, PLATFORM, OR COMMUNICATION WILL BE SAFE, ACCURATE, AVAILABLE, OR SATISFACTORY; OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers apply only to the maximum extent allowed. Nothing in these Terms limits nonwaivable consumer rights.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GUEST HUB, DREAMZONE, AND THEIR MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, USE, OR GOODWILL; SUBSTITUTE ACCOMMODATIONS; OR PROPERTY LOSS, PERSONAL INJURY, OR CLAIMS ARISING FROM A HOST, GUEST, PROPERTY, BOOKING PLATFORM, SMART LOCK, CARRIER, OR OTHER THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID DIRECTLY TO GUEST HUB FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED, INCLUDING WHERE APPLICABLE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR CERTAIN PERSONAL INJURY.

19. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Guest Hub, Dreamzone, and their personnel from third-party claims, damages, losses, liabilities, and reasonable legal fees arising from your unlawful use of the Service, fraud, infringement, unauthorized submission of another person’s information, misuse of access credentials, or material violation of these Terms. This obligation does not apply to the extent a claim results from the protected party’s own negligence, willful misconduct, or violation of law.

20. Termination

You may stop using the Service at any time. We may restrict or terminate access for a material breach, fraud, security or safety threat, legal requirement, or discontinuation of the Service. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnification, dispute resolution, and records needed for legal compliance—will survive.

21. Informal dispute resolution

Before filing arbitration or litigation, the claimant must send a written notice describing the claimant’s name and contact information, the relevant reservation or account, the facts, the specific relief requested, and a good-faith settlement proposal. Send notice by mail to Guest Hub, 2400 Orange Ave, Unit 5104 Cleveland, OH 44101. The parties will attempt in good faith to resolve the dispute for 30 days after receipt. Any limitations period is tolled during that 30-day period to the extent permitted by law.

22. Binding individual arbitration and class-action waiver

Agreement to arbitrate. Except for matters eligible for small-claims court and requests for temporary or preliminary injunctive relief to protect intellectual property, confidential information, safety, or system security, you and Guest Hub agree that any dispute arising out of or relating to the Service, these Terms, communications, or your relationship with Guest Hub will be resolved by binding individual arbitration. The Federal Arbitration Act governs this section.

Rules and location. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, available at https://www.adr.org. The arbitration may occur by documents, telephone, video, or in person as permitted by the rules. Unless the parties agree otherwise, any in-person hearing will occur in the county of your U.S. residence or, if you reside outside the United States, in Cuyahoga County, Ohio. Fees will be allocated under the AAA rules, subject to applicable law.

Individual relief only. The arbitrator may award the same individual remedies a court could award, but only to the individual claimant and only as necessary to resolve that claimant’s claim. YOU AND GUEST HUB WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. The arbitrator may not combine claims of different persons without all parties’ written consent.

Opt-out right. You may opt out of this arbitration section within 30 days after first accepting these Terms by emailing needhelp@guesthub.us with the subject “Arbitration Opt Out.” Include your full name, telephone number, reservation or account identifier if available, and a clear statement that you opt out. Opting out will not affect other Terms or your access to the Service.

Severability of arbitration terms. If the individual-relief limitation is found unenforceable as to a particular claim or remedy, that claim or remedy will proceed in a court of competent jurisdiction after all arbitrable matters are resolved. If applicable law prohibits arbitration of a particular claim, only that claim is excluded.

23. Governing law and courts

Except as governed by the Federal Arbitration Act or another mandatory law, Ohio law governs these Terms without regard to conflict-of-law principles. For disputes not subject to arbitration, you and Guest Hub consent to the exclusive jurisdiction of the state and federal courts located in Cuyahoga County, Ohio, unless applicable consumer law requires another forum.

24. Changes to these Terms

We may update these Terms to reflect changes in the Service, law, security practices, or business operations. We will post the revised Terms with a new effective date and provide additional notice when required. Material changes apply prospectively. Continued use after the effective date constitutes acceptance where permitted; otherwise, we will request consent.

25. General provisions

These Terms, the Privacy Policy, the applicable opt-in disclosure, and any terms expressly incorporated by reference are the entire agreement between you and Guest Hub regarding the Service. A failure to enforce a provision is not a waiver. If a non-arbitration provision is unenforceable, it will be modified to the minimum extent necessary and the rest will remain effective. You may not assign these Terms without our consent; Guest Hub may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. We are not liable for delay caused by events beyond reasonable control. Headings are for convenience. “Including” means “including without limitation.”
